1. Acceptance of Terms

By creating an account, accessing, or using Visibo (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms are a legal agreement between you ("User") and Visibo OÜ ("Visibo").

2. Description of Service

Visibo is a financial management and analytics platform. We provide tools to:

• Import banking transactions via third-party providers.

• Categorize transactions into financial classes (e.g., Revenue, Opex).

• Generate visual reports and financial insights.

Important: We are a technology provider, not a bank, accountant, or financial advisor. The Service is for informational and organizational purposes only.

3. Open Banking & Third-Party Providers

To function, our Service relies on accessing your bank account data.

• Enable Banking: We use Enable Banking Oy ("Enable Banking"), an authorized Account Information Service Provider (AISP), to connect to your financial institutions.

• Authorization: By linking your bank account, you explicitly authorize us and Enable Banking to access, retrieve and store your account information (balances, transactions) on your behalf.

• Availability: We do not control your bank or Enable Banking. We are not responsible for:

  • Downtime or connection failures caused by your bank’s API.

  • Delays in transaction updates.

  • Inaccuracies in the data provided by your bank.

• Re-authentication: For security, your bank connection may expire periodically (e.g., every 90 days). You are responsible for re-authenticating to keep data current.
  
  

4. No Financial Advice (Disclaimer)

The Service does not constitute professional financial, legal, or tax advice.

• Accuracy: While we strive for automation accuracy (e.g., auto-categorizing "Uber" as "Travel"), our system is based on heuristics and AI. It may make mistakes. You are solely responsible for reviewing and verifying the accuracy of all data, categories and reports.

• Decisions: You should not make investment or business decisions based solely on the data presented in the Service. Always consult with a qualified accountant or tax professional before filing taxes or making significant financial moves.
  
  

5. User Accounts & Security

• Eligibility: You must be at least 18 years old to use the Service.

• Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.

• Notification: You agree to notify us immediately of any unauthorized use of your account.
  
  

6. Subscriptions & Payment

• Fees: Access to certain features may require a subscription. You agree to pay the fees associated with your chosen plan.

• Billing: Payments are billed in advance on a monthly or yearly basis.

• Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing cycle.

• Refunds: Payments are non-refundable.
  
  

7. Intellectual Property

• Our IP: We own all rights, title, and interest in the Service, including the code, design, logos and categorization algorithms.

• Your Data: You retain all rights to your personal and financial data. You grant us a license to use this data solely to provide and improve the Service (as detailed in our Privacy Policy).
  
  

8. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, or international law (including money laundering regulations).

• Reverse engineer, decompile, or attempt to extract the source code of the Service.

• Share your account credentials with multiple users (unless on a Team plan).

• Use the Service to build a competing product.
  
  

9. Limitation of Liability

To the maximum extent permitted by law:

• Visibo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

• Our total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the past twelve (12) months.

Specific to Banking: We are not liable for any overdraft fees, interest, or penalties imposed by your bank resulting from your use of (or inability to use) our Service.

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes shall be resolved in the Harju County Court.
